For sure. Election night he could be up by a country mile, but mail in votes in subsequent weeks get it closer and closer. He'll cry foul. Supreme Court gives him the election.
Thinking of another scenario. Mitch tries to force a judge, but vulnerable Republicans like Collins decide that this time they can't go with it. She is losing the election anyways. Why not take a chance

So, the US is hurtling towards a constitutional crisis where it's well within the realm of possibility the election is going to be contested one way or the other, and Supreme Court may be called upon to decide the outcome of the election, and Republican justices now hold a 5-3 majority, and will soon be joined by Tom Cotton or Ted Cruz.
