can't speak for american prosecutors but up here, the police actually lay the charge and the Crown approves or disapproves. There are often pleas (I did some criminal law in the past) and as you get closer to trial and the Crown has to juggle a few trials, you can get them to stay higher charges. I had a guy once who got in a bar fight and cut a guy with a beer bottle. They wanted aggravated, he pled to simple assault and a conditional sentenceDon't they always do that?
