I'd think it might be good news for him actually.
If she was responsible for the props, and was negligent, then he was just an unwitting participant.
He could still be deemed to have been reckless in shooting, but I think it was supposedly at her instruction or something.

I don't know about "criminally responsible" but I think in the civil manner; it might be a bit more of a grey matter in that he was one of the producers of the film. Not just a figurehead title (where you often get 'name actors' get that title in a film) as I believe he's actually owns part of the production company.

This should have been released onscreen. Also, Gyllenhaal does lack the charisma for this type of film. He's no Swayze. Sounds like MCgregor steals the film.
