"Settle it in the courts" is a laughably ignorant take on deplatforming. Who will bring it to court? The social media company, to be able to enforce its TOS? Or the person who is deplatformed, on some newly invented cause of action that reads "Facebook" and "Twitter" into the words "Congress" and "Government" in the first amendment? What if Forumice wants to ban someone for spamming the board with racist, hateful, obvious garbage? Petition the court to let them do it? A foolish suggestion, even for a fool.
Regulating these giant social media monopolies is clearly the right thing to do in the short term. If that means breaking them up using existing anti-trust rules, fine. If it means nationalizing them to prevent the destructive spread of ignorance, OK. Or maybe its a matter of passing some kind of digital platforms legislation that sets objective standards for protected speech (and makes digital platforms subject to first amendment like protection). In that case, Trump would have been banned years ago, and RFK wouldn't even be allowed to have dial-up.
In the longer term, we need entirely new rules to deal with free speech and the Internet.
