None of this was FL law when FSU signed the damned thing?Florida State’s attorney has requested Board of Trustees approval to file legal action against the ACC and the Grant of Rights, per Ross Dellenger of Yahoo Sports. Andrew Carter from the N&O noted the the Board approved the request and the suit will be filed in a Tallahassee Circuit Court. He summarized the claim as follows:
-that ACC’s exit fees, and GOR penalty, violates Florida antitrust law
-that GOR presents an unenforceable penalty
-breach of contract claim
-breach of fiduciary duty claim
Luke DeCock noted that, if successful, FSU may have to go independent for a few years, both the Big 10 and SEC say they're done. But I suspect that if FSU is successful, all bets are off, and the ACC in its current form will cease to exist. Carter also noted that FSU estimates the cost of exiting at $572 million.
IIRC, Florida passed a bill changing their anti-trust statutes expressly to help FSU (or Miami) if they decided to leave the ACC. That part obviously won't pass muster on appeal, but it might be enough to get them out of the Tallahassee circuit. The real issues here are breach of contract and the breach of fiduciary duty claims. Those are intriguing, as I think you could make a case that the ACC mismanaged a pretty wide variety of things involving the establishment of their (not really a) network with ESPN, their most recent TV rights negotiations and the last two rounds of expansion. I'd love to see them sweat Swofford out on the witness stand. That was an attempt to get out of the Tallahassee-based judge issue. A Florida circuit court judge is FAR more likely to ignore timing issues with those anti-trust statutes than a judge from basically any other circuit. But since there are real issues to examine on the breach of duty claims, as dismissive as most observers are ... I do think this deserves a day(week) in court.One of the things they came out today was that the ACC filed suit against FSU in Mecklenburg County yesterday, seeking a declaratory judgement which would have killed FSU’s lawsuit before it was filed.
